General terms and conditions Group outings Breda BV

Article 1: Application
These conditions apply to all reservation requests and packages booked at Groepuitjes Breda BV. Group Outings Breda, Boat Sailing Breda, BAY Breda, Uit jeplaat Breda and the Cooking Studio Breda are trade names of Group Outings Breda BV and are therefore part of it.

Article 2: The main booker
Group outings Breda BV offers various packages. A guest can submit a request for a reservation for an arrangement via the form on the website, via email, telephone or online to make a final booking. The person who places the reservation is seen as the main booker and thus represents the entire group. A definitive booking is deemed to have been concluded on behalf of each participant.

Article 3: Final booking
After receiving a reservation request, Groepuitjes Breda BV will contact the customer and provide a proposal for the request. A booking is final when the customer has received a confirmation email from Groepuitjes Breda BV.
If changes are made to the booking after a definitive booking, the change conditions as stated in Article 4 apply.
If a definitive booking wishes to be cancelled, the cancellation conditions as stated in Article 7 apply.

Article 4: Change booking
A definitive booking can still be changed in terms of: number of participants, time and program content. The booking can only be changed by email and is only changed after confirmation by email.
The number of persons may be changed by a maximum of 25% of the booked number of participants up to one month before the booked outing.
The number of persons may be changed by a maximum of 10% of the booked number of participants or a maximum of 5 persons up to 5 working days prior to the booked outing, depending on the type of outing.
If changes are made 5 working days prior to the booked outing, we cannot guarantee that we can implement the change free of charge.
The arrangements / activities below are an exception to the above rule. A change period of 3 days prior to the booked outing applies for this.
Streetgolf Clinic, Escape City Game, Crazy 88, Verknipte Film, Pubquiz, BAY Games and boat trips without a food component on board.

Article 5: Changing a booking by Groepuitjes Breda BV
Under unforeseen or extreme circumstances, Groepuitjes Breda BV is entitled to change the booked tour. Groepuitjes Breda BV will always try to offer an alternative that is as close as possible to what has been booked. If the client does not agree with the change, Groepuitjes Breda BV will refund the (already) paid amount.
If Groepsuitjes Breda BV decides to adjust the route of a boat trip in connection with extremely high or extremely low water, this is a case of force majeure and the client is not entitled to a full refund.

Article 6: Own consumptions
It is not allowed to consume your own drinks during your visit to BAI Breda.
On board the sloops of Bootje Varen Breda or Zelf Varen Breda, you are allowed to bring and consume your own drinks, with the exception of trips with a skipper that take place between April and October on Fridays from 16.00 pm to 23.00 pm and on Saturdays from 13.00 pm to 23.00 pm. Boat trips with skipper between April and October on Fridays from 16.00 pm to 23.00 pm and on Saturdays from 13.00 pm to 23.00 pm all sail with an arrangement from Bootje Varen Breda on board.

Article 7: Cancellation of a booking
Article 7.1: Cancellation of a booking by the client
The client can cancel the order confirmation by notifying Groepuitjes Breda BV. This must be done by e-mail and also by telephone. A cancellation fee will always be charged. These costs depend on the time of cancellation. We charge 10% of the total booking amount for a cancellation if the cancellation takes place at least 21 days before the start of your outing.
If you cancel 21 to 7 days before the start of your outing, these cancellation costs amount to 25% of the total booking amount.
In case of cancellation from 7 days to half an hour before departure of your tour, a 50% cancellation fee will be charged.
Please cancel in consultation with one of our employees 30 minutes to 1 minute before the start in case of extreme rain and/or thunderstorms. Then the cancellation costs are only 10% of the booking amount. This is only possible in consultation with an employee of Groepsuitjes Breda BV on location and only from 30 minutes before departure, because only then can a good estimate be made of the weather during your activity or trip. Once an activity or tour has started, it can no longer be canceled and therefore no refunds will be made. Please note, these conditions only apply to outdoor activities.
The calculated cancellation costs will be settled as a discount for a subsequent booking, which takes place within 1 year after the original execution date. This only applies to cancellation costs, not to costs incurred for catering.
Article 7.2: Cancellation of a booking with catering products
In addition to the regular cancellation costs, we charge cancellation costs for the ordered/made catering products. If we do not cancel the catering order from our caterer 5 working days before the start of a tour, we must collect and pay for the order from the caterer. We charge these costs in full to the client. Of course, the client can pick up/take away the catering products made since the client has also paid for this. The cancellation costs for any catering vary per package. If the weather is very bad on the day of the outing, we can always offer a dry alternative to eat the catering.
Article 7.3: Cancellation of a booking by Groepuitjes Breda BV
Groepuitjes Breda BV has the right to cancel the agreement up to 7 days before the start if the number of registrations is less than the pre-published minimum number of participants (note! This only applies to special events/tours based on individual registrations).
Groepuitjes Breda BV has the right to cancel a boat trip in extreme weather conditions. Group outings Breda BV is dependent on water levels. If the water level has risen or fallen extremely, Groepuitjes Breda BV cannot sail and has the right to cancel a booking. Full refund in this case applies to the client.
If a boat trip or activity cannot take place due to technical defects in a boat or required product, Groepuitjes Breda is entitled to cancel the boat trip or activity. In that case, full refund applies to the client. In this case, Groepuitjes Breda BV always tries to offer a replacement boat or product, so that a complete cancellation is not necessary.
Groepuitjes Breda BV reserves the right to cancel a tour at any time due to weather conditions due to the safety of its passengers and its own staff.
Groepuitjes Breda BV has the right at all times to cancel the agreement in the event of serious circumstances that are unforeseeable and cannot be remedied or avoided, such as (civil) war, terror, political unrest, natural disasters, food scarcity, general strikes, pandemic et cetera. . Full refund in this case applies to the client.
Article 7.4: Cancellation when booking with a cooperation partner of Groepuitjes Breda BV
An exception to the above conditions are bookings with Collaboration Partners of Groepuitjes Breda BV. For bookings with cooperation partners of Groepuitjes Breda, the cancellation conditions of this partner apply. These terms and conditions will be sent to the guest upon confirmation.

Article 8: Moving a booking
One exception can be made to the above change and cancellation policy. That is when a definitive booking is moved once on request to a new date. In that case, this date must be agreed within 21 days at the latest. If this is not the case, the above cancellation conditions will still apply.

Article 9: Start location Group outings Breda BV
Group outings Breda BV activities always start from BAY Breda, Markkade 1AB in Breda, unless explicitly stated otherwise in the booking confirmation. The starting location in the booking confirmation is always leading.
Pick-up and drop-off point Boat trips
Have you reserved a boat trip via Bootje Varen Breda and would you prefer a boarding point elsewhere in Breda or the surrounding area? Then this is of course possible in consultation, but there must be a stable and easily accessible scaffolding at the desired location. We will then calculate pre-sailing costs, which will be made known to you during the booking process. In most cases the boat is rented a little longer so that the advance sailing is immediately settled. A tour also returns to BAI Breda, the place where the tour also normally starts. If you want to get off at a location other than BAI Breda, this is possible. We will then charge return shipping costs. In most cases the boat is rented longer so that the return sailing is immediately settled.

Article 10: Price and payment
The price to be paid to Groepuitjes Breda BV for the package is stated in the final or amended booking confirmation. All stated amounts include VAT. Payments must be made by invoice 14 days before the date on which the arrangement takes place. The guest is jointly and severally liable for all amounts owed by one of them to Groepsuitjes Breda BV. For cancellation or no-show costs, an invoice will be sent to the guest, which must be paid within 14 days.
The total amount of the boat rental, catering, activities and/or arrangements can be paid by transfer to our bank account NL84 RABO 0312461151 in the name of Groepuitjes Breda BV and stating your invoice number. Payment can also be made through the payment link that is included in the confirmation email that you receive after confirmation.
Any settlements as a result of changes or extra persons on the day of your outing must be paid by you on the day itself by pin or by means of an additional invoice. This payment must be made before the trip starts. If we have to refund an amount, this will be refunded to you by bank transfer within 14 days after the booking.

Article 11: Boat rental without skipper / Sailing yourself
The articles below have an influence on a boat trip of Zelf Varen Breda. This includes all boat trips where no skipper is present from Group Outings Breda, but the guest controls the boat himself. These articles may differ from the articles above.
Article 11.1: Liability
Groepuitjes Breda BV cannot be held liable for personal injury or damage of any kind, regardless of the cause, prior to, during or as a result of a Self Sailing trip. An exception to this is the legal obligation to pay compensation due to demonstrable intent or gross negligence by Groepuitjes Breda BV.
The statutory compensation is limited to a maximum of the boat rental of the relevant waterway. Children are the responsibility of the parents/guardians.
Groepuitjes Breda BV is never liable for direct or indirect damage caused by the tenant on board one of the sloops of Zelf Varen Breda. This damage caused must be mutually agreed upon by the tenant and the other party involved.
In the event of damage to the sloop of Zelf Varen Breda, the main booker is liable up to 250,- for any damage caused to the sloop.
Article 11.2: Passengers and age
The website ZelfVarenBreda.nl indicates the maximum number of people allowed on board per boat for the entire fleet. It is not allowed to board with more people than indicated without consultation. In addition, it is not allowed to leave extra people on board halfway through the trip. The driver of the sloop must be at least 18 years old.
Article 11.3: Sailing times
Self Varen Breda sails (depending on the season and sunset) from 09:00 to 22:00 at the latest. The sailing times of your trip are always determined in advance. If you are late at the boarding location, this will be deducted from your sailing time. If you are late, always inform us by telephone to avoid confusion.
Article 11.4: Boarding and disembarkation location
Self Varen Breda always starts from BAI Breda, this is at the Markkade 1AB in Breda.
There is a large jetty so that you can get in and out very easily and there is a catering location where you can have a drink before and after.
Article 11.5: Change of start time booking by client
When a booking is final, it can only be moved to an earlier or later time in consultation. This can be done free of charge and is only possible if the availability of Zelf Varen Breda allows it.
Article 11.6: Moving booking to another day
Moving a booking is free of charge if it is done by phone or email at least 48 hours before departure. If this is done within 48 hours before departure, 10% travel costs will be charged.
Article 11.7: Change or cancellation of booking by Zelf Varen Breda
Self Varen Breda is entitled to change or cancel the booked tour under unforeseen or extreme circumstances. Self Varen Breda will always try to offer an alternative that resembles what has been booked as much as possible. If the client does not agree with the change or if the trip should be canceled definitively, Bootje Varen Breda will refund the (already) paid amount.
In the event of extremely high or extremely low water, Zelf Varen Breda is entitled to adjust the tour in such a way that this does not affect the result of the normal tour.
Self Varen Breda has the right at all times to cancel the agreement in the event of serious circumstances that are unforeseeable and cannot be remedied or avoided, such as (civil) war, terror, political unrest, natural disasters, food scarcity, pandemic or general strikes, etc. . Full refund in this case applies to the client.
Article 11.9: Cancellation by the tenant
The client can cancel the order confirmation by notifying Bootje Varen Breda. This must be done by e-mail and also by telephone. A cancellation fee will be charged.
11.9.1 Cancellation up to 72 hours before departure
Canceling a definitive booking is free of charge if the tour is canceled 72 hours before the tour departure.
11.9.2 Cancellation within 72 hours to 1 hour before departure
In case of cancellation of a definitive booking that takes place between 72 hours and 1 hour before departure, a 25% cancellation fee will be charged.
11.9.3 Cancellation within 60 minutes to one minute before departure due to rain and/or thunderstorms
Please cancel in consultation with one of our employees 60 minutes to 1 minute before the start in the event of (extreme) rain and/or thunderstorms. Then the cancellation costs are only 10% of the booking amount. This is only possible in consultation with an employee of Bootje Varen Breda and only from 60 minutes before departure, because only then can a good estimate be made of the weather during your trip. If you have to cancel last minute due to bad weather, you will receive the 10% cancellation fee as a discount on a new booking.
11.9.4 Cancellation if a tour has already started
Once a tour has started, it cannot be canceled and no refunds will be made.
Article 11.10: Consumptions on board
It is allowed to bring your own drinks and snacks on sailing trips of Zelf Varen Breda. It is of course also possible to buy drinks and snacks for on board at BAAI in advance.
The skipper or several skippers you have chosen must always remain sober and must never be under the influence of alcohol or drugs. Drinking water is important for the skipper himself, the other passengers, other people on the water and the boat. Enforcement also frequently checks this on the water. Self Varen Breda is not responsible for any form of damage caused by intoxicated skippers.
If it appears beforehand that tenants are under the influence of alcohol (drunkenness) or drugs, access to the boat can be denied. This does not release the renting party from his or her obligations!
Article 11.11: Waste and environment
The renting party is expected to handle the environment and the Breda water with care. This means that we keep the environment clean. All drinks and associated waste that you bring along must be removed from the boat after the trip.
Article 11.12: Sailing route
It is not allowed to sail further than the Friso Bridge. Should the boat continue to be sailed, the boat trip will be terminated immediately without any right to a refund. The boats are equipped with a GPS tracker.

Article 11.13: Conduct on board
The Bredase Singels sail around the city center through residential areas and parks. For that reason, the tenant must behave properly on board and not cause any nuisance. In the event of nuisance and violations, the trip through Zelf Varen Breda or other enforcement services can be terminated immediately, without any right to a refund of the amount paid.
Article 11.14: Toileting
Unfortunately, there are no toilet stops during the route. It is only possible to return halfway to BAY for a toilet stop. It is absolutely not allowed to urinate in the Bredase Singels. When this is observed, the tour will be stopped immediately without any right to a refund of the amount paid.
Article 11.15: Sailing speed for tenants without skipper
Within Breda it is not allowed to sail faster than 4,5 km/h. Outside Breda, in many places a maximum sailing speed of 6 km/h applies. At a normal speed you can sail a nice trip as indicated by us. Sail especially calmly if another sailing boat, a houseboat or a harbor with boats comes near you and also when mooring and mooring. Sailing too fast causes unnecessary nuisance and environmental pollution. In the event of nuisance and violations, the trip through Zelf Varen Breda or other enforcement services can be terminated immediately, without the right to a refund of the amount paid.
Article 11.16: Timely return of rented sloop
If you have rented a boat without a skipper, you will have plenty of time to sail around the canals (and the rest of Breda). Make sure you are back with the sloop at the agreed time so that the next group can start sailing on time. If you return the sloop too late, you will be charged € 10 per 25 minutes.

Article 12: House rules and rules of conduct
The customer and each guest must adhere to the house rules and rules of conduct established by Groepsuitjes Breda BV and/or follow the instructions of (employees of) Groepsuitjes Breda BV.
These house rules and rules of conduct are valid at all locations of Groepsuitjes Breda BV and all locations where activities or arrangements of Groepsuitjes Breda BV take place.

Article 13: Liability
Groepuitjes Breda BV cannot be held liable for personal injury or damage of any kind, regardless of the cause, prior to, during or as a result of activity. An exception to this is the legal obligation to pay compensation due to demonstrable intent or gross negligence by Groepuitjes Breda BV. The statutory compensation is limited to a maximum of the costs of the relevant activity. Children are the responsibility of the parents/guardians.
The participant and/or the client is liable towards Groepsuitjes Breda BV for damage or any other disadvantage caused by the act or omission of himself, or of third parties "approved" by him. The main booker is therefore liable for damage or any other disadvantage caused by the acts or omissions of persons belonging to his or her group for which the outing has been booked.
It is possible that Groepuitjes Breda BV will make a combination booking for you of a boat trip with an activity of an external partner, such as a restaurant. In some cases, other conditions and rules apply to the activity of the partner company than to the activities of Groepuitjes Breda BV. It is the responsibility of the client to request the general terms and conditions of the partner companies. Groepuitjes Breda BV cannot be held liable for personal injury or damage of any kind, regardless of the cause, prior to, during or as a result of the activity of the partner company. All partners are carefully selected by us.

Article 15: Privacy
When requesting a reservation and confirming a booking, personal data of the customer is processed, namely first and last name, telephone number, e-mail address and address details. Information about the processing of this personal data can be found in our privacy statement, which is published on our website.

Article 16: Applicable law and disputes
Dutch law applies to all agreements concluded with Groepuitjes Breda BV. All disputes will be submitted to the competent court of the Zeeland-West-Brabant District Court.
