General Visitor Conditions Breda Floats

These General Terms and Conditions for Visitors are of the private limited company
liability Groepuitjes Breda BV (hereinafter: 'DRIJFT'), Chamber of Commerce number 66395739, and its
applies to all agreements concluded with visitors to events organized by it or on its behalf, including Breda Drijft 2021.

Article 1 Definitions
FLOATS:
The private company with limited liability Groepuitjes Breda BV whose business includes providing services in the field of performing arts and organizing events and the associated activities and services;

Visitor:
Any natural person who does not act in the exercise of a profession or business and who directly
or indirectly enters into an agreement with DRIJFT in the context of attending an Event, as well as anyone who is in, on or around the Event Location;

Event:
An event lasting one or more days, including a (music) performance and/or other
manifestation, a concert, dance event, business event or festival in which one or more persons participate, organized and/or facilitated by or on behalf of DRIJFT at the event location;

Event location:
Location(s) where an Event takes place, which has been deployed
for the purpose of organizing and/or facilitating by or on behalf of DRIJFT.

General Visitor Conditions:
The present General Terms and Conditions for Visitors that apply to the (legal) relationship between the Visitor and DRIJFT;

Agreement:
Any legal relationship under the law of obligations between the Visitor and DRIJFT that has been established in accordance with these General Terms and Conditions for Visitors and/or ensues from this in connection with attending an Event, as well as any other legal relationship in accordance with these General Terms and Conditions for Visitors that is legally valid on the (legal) relationship between the Visitor and DRIJFT provision or statement declared applicable;

(Advance) sales address:
A (advance) sales organization engaged by DRIJFT for the sale of admission tickets for Events, including those where online/digital admission tickets can be purchased;

Admission ticket:
A validly obtained proof, provided by or on behalf of DRIJFT, showing that the Visitor is authorized to be at the Event Location;

Entrance fee:
The price for an Admission Ticket, as stated on the Admission Ticket, excluding any additional service and/or administration costs;

Article 2 Applicability
2.1 These General Terms and Conditions for Visitors apply to every Agreement that has been concluded
between FLOATS and the Visitor regardless of the manner in which this Agreement is concluded, as well as on every visit by the Visitor to the Event Location.
2.2 DRIJFT has the right to these General Terms and Conditions for Visitors at all times in whole or in part
partially change. FLOATS will inform the Visitor in a timely manner of the changes to the Terms
Inform visitor conditions by reporting this on its Social Media. If the
Visitor believes that the changes are contrary to reasonableness and fairness, then
the Visitor FLOATS must notify this within 10 (ten) working days after the notification
messages, failing which the Visitor agrees to the changes.
2.3 The nullity of any provision of these General Terms and Conditions for Visitors will affect the
validity of the other provisions of these General Terms and Conditions for Visitors.
2.4 On the purchase of an Admission Ticket, in addition to the General Visitor Conditions,
(also) any (general) terms and conditions of the ticket provider are applicable.

Article 3 Offers and conclusion of Agreement
3.1 Information, offers, notices and quotations related to Events
and/or (the sale of) Admission Tickets are given or provided as accurately as possible by DRIJFT and/or third parties orally, by telephone, by e-mail, via the Website(s) and/or Social Media. DRIJFT accepts no liability for any inaccuracies or omissions in the aforementioned communications made by DRIJFT and/or third parties.
3.2 An Agreement is concluded the moment the Visitor purchases an Admission Ticket
at DRIJFT or a (Advance) sales address engaged by DRIJFT, or has accepted an offer from or on behalf of DRIJFT to acquire it, whether or not against payment, and/or upon entering the Event Location.

Article 4 Admission and Admission Ticket
4.1 When entering the Event Location and during the period that the Visitor is present at the Event Location, the Visitor must have a valid proof of identity, a valid (obtained) Admission Ticket and (if deemed necessary by the Dutch government) a negative PCR test. test or vaccination passport and show this at the first request of employees of DRIJFT, employees of the Event Location, security personnel, police and/or other competent authority. If it turns out that the Visitor is under the age of 18 or is not in possession of one of the above documents, access to the Event will be denied without further ado, unless explicitly determined otherwise by DRIJFT, without DRIJFT being obliged to refund the Admission Price. or any service and/or administrative costs charged and/or costs otherwise incurred.

4.2 An Admission Ticket is issued to a Visitor once and gives to one Visitor
one-time access to the Event and the Event Location and loses after leaving
the Event Location automatically expires.
4.3 An Admission Ticket only grants the holder of the Admission Ticket access to the Event Location. It is the Visitor's own responsibility to ensure that he becomes and remains the holder of the Admission Ticket. Admission tickets are and remain the property of DRIJFT.
4.5 An Admission Ticket consists of a document with a barcode provided by or on behalf of DRIJFT. The barcode is a unique code that is provided to the Visitor via electronic communication (e.g. e-mail). If the Visitor has chosen to receive the Admission Ticket in this manner, the Visitor must ensure that this Admission Ticket can actually be provided in a secure manner via electronic communication. DRIJFT guarantees neither the
confidentiality nor receipt of the Admission Ticket.
4.6 Only purchase via DRIJFT or (Advance) sales addresses engaged by it
guarantees the validity of the Admission Ticket. Admission tickets can be by or on behalf of
DRIJFT be declared invalid and/or the Visitor may be denied access to the Event Location by or on behalf of DRIJFT if it turns out that the Admission Ticket was not obtained from DRIJFT or from a (Advance) sales address engaged by DRIJFT or in the event of fraud , abuse and/or other violation of (one of) the rules laid down in Articles 4.1 to 4.11 inclusive.
4.7 From the moment the Admission Ticket is made available to the customer, the

change or otherwise affect the intellectual property rights of DRIJFT
feel.
4.9 DRIJFT reserves the right to set a maximum for the number of Admission Tickets that may be obtained per (potential) Visitor; the (potential) Visitor is in that case obliged to comply with this.
4.10 Access to DRIJFT events that take place in the open air means
Visitors with a valid admission ticket are in principle open until 17.00 p.m. After 17.00:XNUMX PM
hours, Visitors will no longer be admitted to the event location, unless DRIVES in
decided otherwise in a specific case.

Article 5 Prohibition of resale of Admission Tickets
5.1 It is prohibited to pass on an Admission Ticket to third parties in any way whatsoever.

5.3 If the Visitor does not comply with the obligations under this article, DRIJFT
entitled to regard those Admission Tickets as invalid, he may be denied access to the Event. The holder of an invalid Admission Ticket will not be allowed access to the Event or the Event Location and will not be entitled to any compensation.

Article 6 Liability
6.1 Traveling to and from as well as entering, staying and performing activities at and leaving the Event Location and attending or participating in the Event at the Event Location is entirely at the Visitor's own risk. DRIJFT will ensure that all reasonable measures have been taken to avoid damage to Visitors. DRIJFT is not liable for any damage, by whatever name, that the Visitor may suffer as a result of participation, unless this damage is the direct result of intent or gross negligence attributable to DRIJFT. This exclusion of liability also applies to serious damage such as all possible damage resulting from injury or death.
6.2 DRIJFT is not liable for damage as a result of the cancellation,
change or relocation of an Event, nor for any other damage of any kind
for whatever reason, which is directly or indirectly the result of acts or omissions on the part of DRIJFT
and/or the subordinates, non-subordinates, auxiliary persons, third parties and/or other persons engaged by it in the context of the Event, during or in connection with the
Event, including traveling to and from or staying at the Event Location, unless the
damage is the result of intent or gross negligence on the part of DRIJFT.
6.3 DRIJFT excludes liability for the manner in which the program of the
Event, whether or not in an amended form, is given substance, including
the content and duration of the program of the Event.
6.4 If and insofar as FLOATS, despite the provisions of these General Terms and Conditions for Visitors, should be liable towards the Visitor for any damage suffered by the Visitor, this liability is at all times limited to direct damage and to the amount that is covered under the relevant liability insurance of DRIJFT will be paid out, and only if it is legally obliged to do so. In the event of a shortcoming, DRIJFT is only liable in such a case if the Visitor immediately and properly informs DRIJFT of the shortcoming in writing, whereby a reasonable period is also set for

that notice of default continues to fail in the fulfillment of that obligation or the repair
of the error.
6.5 DRIJFT excludes its liability for loss of clothing, goods and/or other
property of the Visitor and as such accepts no liability. If the Visitor can demonstrate with concrete evidence that loss of clothing, items and/or other
property of the Visitor is exclusively the result of intent or gross negligence on the part of
(personnel of) DRIJFT, the Visitor must inform DRIJFT immediately and in writing
under penalty of forfeiture of any claim for compensation and will FLOATS
upon presentation of a valid proof of purchase of the relevant property(s) to that
pay the Visitor compensation up to a maximum of the purchase amount, with a
maximum of € 250 (in words: two hundred and fifty euros).
6.6 Found objects must be handed over to employees of DRIJFT. Found objects are kept by DRIJFT for two weeks, during which period the rightful owner can collect the property(s) he or she has lost from DRIJFT.
6.7 DRIJFT excludes its liability for indirect damage, consequential damage, hearing damage, visual damage, blindness and/or other physical injury of the Visitor in connection with the Event. The Visitor is expressly aware that loud and/or amplified music may be played during the Event and at or around the Event Location.
6.8 The Visitor must be adequately insured against the risk of damage that he or a surviving relative may suffer as a result of his death, injury or illness, caused by his or her participation in the Event.
6.9 The Visitor indemnifies DRIJFT against liability for damage that third parties may suffer as a result of an act or omission related to the Event that can be attributed to the Visitor. The Visitor must be adequately insured against the risk of liability for such damage.
6.10 Drijt cannot be held liable if a visitor cannot participate in Breda Drijt 2021 due to a positive Covid test or other Covid-related reason. In this case, no refund will be made in any form whatsoever.
6.11 The provisions of this article also apply for the benefit of all (legal) persons used by DRIJFT in the performance of the Agreement.

Article 7 Change, cancellation or relocation Event
7.1 DRIJFT is entitled to cancel (parts of) an Event, if DRIJFT considers there to be sufficient reason to do so, without the Visitor being entitled to any compensation as a result. DRIJFT will inform the Visitor of a cancellation as soon as reasonably possible. In case of force majeure, article 9 (Force Majeure) applies. If there is no question of force majeure, the Visitor is entitled to a refund of the Admission Price, but not to the administration and service costs.
7.2 DRIJFT is entitled to change (parts of) an Event, such as the programme, the location, the layout, the times, without the Visitor being entitled to any compensation as a result. It is the responsibility of the Visitor to check whether an Event has been changed. In the event of a change, DRIJFT will do its best to ensure that the Visitor is informed as soon as it is aware of this. However, DRIJFT cannot guarantee that the Visitor will receive this information before the start of the Event. In the event of a change, DRIJFT is not obliged to reimburse or refund the Admission Price of the Admission Ticket and any service, payment and/or administration costs charged and/or costs incurred otherwise.
7.3 Tickets for Events that are moved remain for that moved
Event valid in principle.
7.4 If an Event is moved by or on behalf of FLOATS to another
date, the Admission Ticket remains valid for the new date on which the Event will take place. If the Visitor is unable or unwilling to visit the Event on the new date, the Visitor is entitled to return the Admission Ticket to DRIJFT or to a (Advance) sales address engaged by DRIJFT. In case of force majeure, article 9 (Force Majeure) applies. In the absence of force majeure, the Visitor is entitled to a refund of the Admission Price stated on the Admission Ticket, regardless of the price the Visitor paid for the Admission Ticket. Service and/or administration costs will not be reimbursed.

Article 8 House Rules Event
8.1 The House Rules of
FLOATS apply. Visitors are held to comply with this
House rules of DRIJFT and/or the Event Location as well as the social
to behave in accordance with the rules of good decency and good morals. If the Visitor
in the opinion of employees of DRIJFT and/or the Event Location and/or
security personnel do not behave in such a manner, the Visitor can pass
employees of FLOATS and/or the Event Location and/or security personnel

costs.
8.2 The Visitor is not allowed to record the visit to the Event, in which way
in any form whatsoever, on any (digital) carrier whatsoever, including photographing,
filming, or any other way of making sound and/or image recordings of the
Event. If the Visitor has the Event in a non-professional sense
recorded, such as with a smartphone, then the Visitor is only allowed these recordings
for their own private use and may not be used by the Visitor in any way
be used or disclosed for commercial purposes.
8.3 DRIJFT reserves the right to make sound and/or sound recordings during an Event
to take pictures. The Visitor visiting an Event:
a. agrees to the recording and/or (re)use of his/her name, voice, portrait and/or
image through live or non-live broadcast and recorded audio and video
display, broadcast or other form of distribution including photographs or other present
and/or future media technologies; and
b. gives unconditional permission for the (re)use as referred to in sub a).
indefinitely, worldwide and free of charge; and
c. neither DRIJFT nor parties that use with permission from DRIJFT
making image and/or sound material for commercial or non-commercial purposes,
liable for the (re)use of this image and/or sound material; and
d. waives his/her image right, image right and persona right as far as it is concerned
for images in and around the Event Location in which he/she is recognizable;

e. acknowledges that a video surveillance system is operational and agrees that continuing
or on behalf of DRIJFT in the context of public order and safety video recordings
can be made of the Visitor; and
f. acknowledges that possible intellectual property rights, including copyrights and
neighboring rights, with regard to the images/images made by or on behalf of the Visitor
or sound material, become the undivided property of DRIJFT; at DRIJFT's first request, the Visitor will fully cooperate, free of charge, with any formalities necessary to effect a transfer of rights or granting of rights in any other way; DRIJFT is at all times entitled to use the image and/or sound material referred to here made by or on behalf of the Visitor (or have it used), in any way whatsoever.
8.4 The Visitor is not permitted without the express written permission of
FLOATS, including promotional material at the Event Location
to distribute or have distributed samples, flyers, advertising and/or folder material insofar as the law
this allows.
8.5 Smoking is only permitted at the Event Location in the designated areas
(smoking) room(s). Outside these (smoking) area(s) it is expressly not allowed to smoke.
DRIJFT will make every reasonable effort to ensure that the Visitor is smoke-free
of (parts of) the Event Location. However, DRIJFT does not guarantee this
that the Event is completely smoke-free. The Event is not (or cannot be) completely smoke-free
does not entitle the Visitor to a refund of the Admission Price or any other compensation.
Violation of the smoking ban by the Visitor will, if possible, result in immediate disciplinary action
removal of the Visitor from the Event and the Event Location. Any if
fines imposed on DRIJFT as a result of this violation of the smoking ban will increase
be recovered from the Visitor. In this context, smoking is also understood to mean electric
smoking.
8.6 DRIJFT will undertake everything that is reasonably within its possibilities to
to guarantee the safety of the Visitor at the Event Location as much as possible. In
in the context of security at the Event Location, the Visitor is therefore obliged to
first request from employees of DRIJFT and/or the Event Location,
security personnel, police and/or other competent authority:
to lend his or her cooperation to an investigation of clothing (search), both at the
access to the Event and the Event Location as well as during the stay at
the Event and the Event Location; and/or to provide access to the (hand/back/carrying) bag(s) that have been brought along, both at the entrance to the Event and the Event Location and during the stay at the Event and the Event Location; and/or
b. pass through a detection gate; and/or
c. identify themselves both when accessing the Event and the Event Location
as well as during the stay at the Event and the Event Location.
The Visitor who does not wish to submit to this, can access the
Event and the Event Location are refused or denied without entitlement
refund of the Admission Price or compensation otherwise.
8.7 The Visitor is not allowed to (unnecessarily) stay in front of emergency exits and
places at the Event Location where fire extinguishers or other fire-resistant and/or
whether safety measures have been taken.
8.8 The Visitor is expressly not allowed to use professional photo, film, drone and/or sound/or other recording equipment, glassware, plastic bottles, cans, fireworks, drugs, laughing gas cartridges, (fire) weapons and/or other dangerous objects and/or substances, food and/or
to bring (alcoholic) drinks and/or (pets) animals to, or at least to have them in possession
at the Event Location, under penalty of seizure of these items and/or transfer to
the police.
8.9 The Visitor is not permitted to use (the inventory of) the Event Location in any way
to affect and/or damage it. The Visitor is also not allowed
to endanger other visitors, staff and/or employees of
DRIFT and/or (personnel and/or employees of) contractors and emergency services, under
others by climbing on objects and/or being on/in objects that are on or around the
Event location are present (such as stages, fences, containers, etc.). If
the Visitor causes damage to (the inventory of) the Event Location in any way, the Visitor is obliged to compensate this damage.
8.10 The Visitor is bound by instructions, regulations and/or instructions from employees
FLOATS and/or the Event Location, security personnel, the police and/or others
competent authority on first request. These instructions can also monitor it
preventing (undesired) group formation, aggressive behaviour, indecent or offensive behaviour
behaviour, calamities, endangerment, discrimination, insult, threat, carrying
provocative clothing, badges, badges, headgear and flags etc.
8.11 If the Visitor refuses to comply with the (safety) regulations referred to in this article 8
the Visitor may become the access to the Event and/or the Event Location
denied and removed from the Event Location, without the right to any
reimbursement of the Admission Price of the Admission Ticket and any fees charged
service and/or administrative costs and/or otherwise incurred costs.
8.12 Employees of DRIJFT and/or the Event Location, security personnel, the police
and/or other competent authority may inform the Visitor in the event of a violation as referred to in this Article 8
request to come along at any time, be requested a copy of his valid
proof of identity and can then be removed from the Event Location.
In that case, the Visitor will at all times cooperate voluntarily, without resistance
such a request. DRIVES will subsequently, whether or not during or after the Event
in consultation with the relevant authorities, decide whether the Visitor can request a denial for one or
several Events of DRIJFT will be imposed.
8.13 Consumption vouchers or coins purchased during the Event or during the stay on the
Event location are only valid during the relevant Event and can
cannot be exchanged by the Visitor. FLOATS will during and after the
Event never to refund the purchase amount of these vouchers or coins
pass. It is not possible to transfer or re-purchase consumer vouchers or coins that have already been purchased
to sell. Visitors are prohibited from passing on purchased consumption vouchers or coins
(to) sell.

Article 9 Force majeure
9.1 DRDRIJFT is not obliged to fulfill any obligation if it is prevented from doing so as a result of force majeure. DRIJFT can decide at a late time on the grounds of force majeure not to allow the Event to take place. DRIJFT cannot be held liable for damage suffered by the Visitor as a result of force majeure and as such does not accept any liability. Force majeure also includes, but is not limited to: strikes, fire, (extreme) weather conditions, epidemics, COVID-19 (or coronavirus), (threat of) terror, the withdrawal of the event permit due to a negative water inspection, and all other external causes, foreseen or unforeseen, as a result of which DRIJFT is unable to fulfill its obligations.
9.2 If the Event is shut down, changed, moved or canceled due to force majeure, DRIJFT will refund the already paid Admission Price of the Admission Ticket up to any positive balance that remains after settlement of the costs incurred for the Event, taking into account the amount which may be paid by the insurer. DRIJFT is not obliged to reimburse or refund the charged service, payment and/or administration costs and/or costs incurred in any other way.
9.3 In the event of shutdown, change, relocation or cancellation of the Event as a result of force majeure, DRIJFT is not obliged to pay any compensation.
9.4 If DRIJFT cannot allow the Event to take place due to COVID-19, DRIJFT will have the Event take place at a later time in 2020 or in 2021 if the situation surrounding COVID-19 allows it. If the Event cannot take place at a later time in 2020 or 2021 due to COVID-19, a refund will be made

Article 10 Privacy and personal data
10.1 By concluding an Agreement with DRIJFT (personal) data of the
Visitor are collected, recorded and stored in a data file. This one through
(personal) data provided by the Visitor will be processed by DRIJFT.
10.2 The processing of the (personal) data provided by the Visitor is governed by the privacy policy
of FLOATS applies.
10.3 When concluding the Agreement with DRIJFT, the Visitor expressly agrees
permission to process (personal) data
10.4 If during an Event (image) recordings are made with security cameras,
DRIVES can transfer this to third parties, including the police, in the event of calamities
and justice.

Article 11 Complaints
DRIJFT will do everything that is reasonably within its possibilities to make it
to make the Visitor's stay at the Event Location as pleasant as possible during the Event
to make. DRIJFT tries to minimize any nuisance or inconvenience for the Visitor
to a minimum and to guarantee the safety of the Visitor as much as possible. Should

Article 12 Disputes
These General Terms and Conditions for Visitors and all Agreements to which these General Terms and Conditions
Visitor conditions apply, only Dutch law applies. Any dispute arising from an Agreement or in connection with an Agreement will be submitted exclusively to the competent court in the district of Zeeland – West Brabant.
